Wage and hour compliance remains a particularly challenging area for home care agencies to master and presents one of the highest risks of legal liability. This session will guide you through the steps every company can take to reduce its legal risk. Gain an understanding of the home care practices targeted in recent lawsuits and government investigations – including live-in and 24-hour shifts, pay per visit claims, rate manipulation claims, and timekeeping best practices. Come out of this interactive session able to identify potential problems and with a better understanding of the compliance materials available on the home care toolkit to assist with your plan for improvement.

 Learning Outcomes:

 • Gain an understanding of how a new President and administration have impacted the home care industry, what changes to wage-and-hour legislation mean for your business, and how to prepare for the future.
• Learn how to put policies and procedures in place for calculating and paying for time spent traveling, waiting, in orientation, for meals, rest periods and live-in shifts.
• Explore the key components of a compliance plan and how to implement a compliance plan.
• Learn about what is happening with the DOL’s proposed salary increase, commonly targeted practices including pay per visit, how to properly pay and document the status of your staff, and what you can do to shield yourself from litigation.
• Gain an understanding of applicable exemptions, including what they are and how to effectively use them in your business.
